Article 2 – Purpose

These Terms of Service (the "Terms") govern access to and use of the Portal. The Portal allows the user (the "User") to create an account, describe a property acquisition project, upload the supporting documents needed to review the file and track the progress of the financing application.

The Terms do not govern the brokerage engagement itself, which is covered by a separate non-exclusive mortgage brokerage mandate signed between the User and Invexa (the "Mandate"). In the event of conflict, the Mandate prevails.

Article 3 – Acceptance

Validating the profile constitutes full acceptance of the Terms, confirmed by ticking a checkbox. Invexa may amend the Terms; the User will be notified of any material change and must accept it to continue using the Portal.

Article 4 – Access and account creation

The Portal is reserved for adults with full legal capacity and for legal entities acting through a duly authorised representative.

The User undertakes to provide accurate, complete and up-to-date information and to update it if it changes. Inaccurate information may lead to suspension of the account and jeopardise the review of the file.

The User is solely responsible for keeping their login credentials confidential. Any action taken from their account is deemed to have been taken by them. The User must inform Invexa without delay of any unauthorised use.

Article 5 – Services

Invexa acts as an intermediary: it searches for, compares and presents financing offers from partner credit institutions. Invexa is not a lender and does not guarantee that financing will be obtained or on what terms; the lending decision rests solely with the lending institution.

Simulations, indicators and estimates displayed on the Portal (borrowing capacity, debt-to-income ratio, monthly payments) are indicative only and do not constitute a loan offer or a commitment by Invexa or any bank.

A loan is a commitment and must be repaid. Check your ability to repay before committing.

Article 6 – Uploaded documents

The User warrants that the documents they upload are authentic and complete and that they are entitled to share them, including where they relate to a co-borrower. The User authorises Invexa to analyse them, including through automated data-extraction tools subject to human review, and to share them with the lenders and insurers approached for the User's file.

Submitting forged documents or false information may constitute a criminal offence and will lead to immediate closure of the account.

Article 7 – Regulatory obligations (AML/CFT)

Under the French Monetary and Financial Code (Articles L561-1 et seq.), Invexa must verify its clients' identity, the source of funds and the purpose of the transaction. The User undertakes to provide any supporting document requested for this purpose. Failing this, Invexa will be unable to continue the relationship.

Article 8 – Fees

Access to the Portal is free of charge. Any remuneration of Invexa is set exclusively by the Mandate and, in accordance with Article L519-6 of the French Monetary and Financial Code, no payment may be required from the User before the loan funds have actually been disbursed.

Article 9 – Availability and security

Invexa uses reasonable efforts to ensure the Portal's availability and security, without any guarantee of result. Access may be interrupted for maintenance, updates or force majeure.

The User shall not interfere with the Portal's operation, including through intrusion, automated data scraping, uploading malicious code or circumventing security measures.

Article 10 – Liability

Invexa is not liable for damage resulting from inaccurate information provided by the User, misuse of the Portal, service interruptions beyond its control or decisions made by lending institutions. Nothing in these Terms limits the statutory rights of a User acting as a consumer.

Article 11 – Intellectual property

The Portal, its structure, content, trademarks and logos belong to Invexa or its partners. Any reproduction or use without prior written consent is prohibited. The User retains ownership of the documents they upload.

Article 12 – Personal data

User data is processed in accordance with Invexa's Privacy Policy, available on the Portal.

Article 13 – Term, suspension and closure

The account is opened for an indefinite period. The User may request its closure at any time at louis@invexa.fr. Invexa may suspend or close an account for breach of the Terms, for regulatory reasons or after more than [24] months of inactivity, with prior notice except in urgent cases. Data is then retained for the statutory periods set out in the Privacy Policy.

Article 14 – Complaints and mediation

Complaints may be sent to louis@invexa.fr or by post to JAYLO – Invexa, 12 La Rue, 50330 Carneville, France. Invexa acknowledges receipt within 10 business days and responds within 2 months at most.

If no solution is found, a User acting as a consumer may refer the matter free of charge, within 12 months of their written complaint, to the consumer mediator: IEAM, 31 bis et 33 rue Daru, 75008 Paris, France (ieam-paris@wanadoo.fr).

Article 15 – Governing law and jurisdiction

These Terms are governed by French law. Any dispute falls within the jurisdiction of the competent courts of Paris, subject to mandatory consumer protection rules allowing a consumer to bring proceedings before the courts of their place of residence.

Article 16 – Language

These Terms are available in French and English. In the event of any discrepancy, the French version prevails.
